Medicaid Home Care Advocacy Training

New York’s Medicaid home care program is the most comprehensive in the country, enabling about 100,000 elderly or disabled persons a year to remain in their homes.  As the government has cut back on all entitlements in the last decade, changes in policy make it more difficult to access home care.  Aggressive advocacy is needed to obtain the amount of home care that clients need, but this requires intensive development of facts and medical evidence. 

This training will explain to viewers the differences between the six different Medicaid home care programs, how to prepare medical documentation and win benefits for their clients, either through advocacy at the local Medicaid offices run by the Department of Social Services in each county (the “CASA” offices in NYC),  by advocacy with certified home health care agencies (CHHAs), or by representing clients at a fair hearing.

Because of its length, this training has been broken into three parts.  It is not required that all three parts of this training be viewed in order to receive CLE credit. 
Application for accreditation of this course or program in New York is currently pending for approval as a New York CLE transitional program.

As a non-traditional format course, no CLE credit will be available to newly admitted attorneys (less than 2 years).

Medicaid Home Care Advocacy Training - Part 1

Learn the six different types of home care and which one suits your client:

o   Personal care/home attendant

o   Certified home health care (CHHA),

o   Waiver services (Lombardi, TBI, Nursing Home Diversion & Transition Waiver),

o   Private Duty Nursing,

o   Managed Long Term Care &

o   Consumer Directed Personal Assistance Program). 

What are the eligibility criteria, and which agency approves care.   Learn about the financial issues in home care – how does each program treat the “spend-down,” spousal refusal, pooled trusts, transfers of assets, and the changing “spousal impoverishment” protections in the waiver programs (Lombardi, TBI)

Medicaid Home Care Advocacy Training - Part 2

How to prepare an application for personal care (a/k/a home attendant) services that will have a better chance of being approved in the amount of hours your client needs.   The application is based on the treating physician’s order, called the “M11q” in New York City.   Learn how the local DSS (CASA) evaluates requests and what standards it uses, and how to advocate at the local DSS (CASA) for more hours.   Though the New York City physician’s order form will be discussed, the applicable regulations and policies are statewide.
